The Terms & Conditions outlined on this page apply to the use of the Espadrille website. By accessing this website or by ordering you agree to be bound by the terms and conditions set out.
DEFINITIONS
Espadrille is a trading name of Test IT Ltd Registration No 3133469.
CONDITIONS
Nothing in these terms and conditions shall affect your statutory rights.
Espadrille retains the right to alter these Terms and Conditions at any time, but this right should not affect existing Terms and Conditions accepted by you upon making a purchase.
We also reserve the right to adjust the price and specification of any item on this website at our discretion, and withdraw any items from sale.
OUR PRODUCTS
We make every effort to show the colours of our fabrics and products as accurately as possible. However, the processing of the digital images used, lighting conditions during photography and the settings of your computer monitor mean we cannot absolutely guarantee that the colours you see on your screen will be exactly the same as how the products appears in natural sun light.
Our espadrilles are sized according to the European sizing convention and are in whole sizes only, with one width per size. The fit of the espadrilles cannot be guaranteed as they can stretch after being worn for a while.
Whilst every reasonable effort is made to ensure the accuracy of information on our website, we can make no warranties, whether express or implied in relation to its accuracy.
Any items sold by Espadrille, or digital images and graphic artwork used on its website, may be the subject of patent rights and/or other legal protection.
PRICE AND PAYMENT
The price of our products is shown on the Espadrille Website. The prices quoted are inclusive UK VAT but exclude Shipping, Postage and Packing. Shipping, Postage and Packing charges stated are for United Kingdom mainland only and include VAT. Shipping costs to other destinations i.e. European Countries, or Worldwide may incur extra costs.
The total purchase price, including VAT and delivery charges, if any, will be displayed in your shopping cart before final confirmation of payment is required.
Espadrille reserves the right to change the total purchase price including VAT and delivery charges.
Payment must be received in full before an order can be despatched.
Espadrille accepts payment for orders by Credit/Debit Card, Cheque, Postal Orders, and Bank Transfer. However, we reserve the right to refuse payment by one or more of these payment methods if deemed necessary.
If you wish to pay by Bank Transfer, payment must be made to Espadrilles account via Natwest Bank (bank details can be obtained by phone from Espadrille). Cleared funds must be received by Espadrille before goods are despatched. We are afraid that we cannot accept responsibility for charges resulting from such Bank transfers.
Personal cheques must be accompanied with a valid cheque card guarantee number and expiry date written on reverse side of cheque. Cheques made payable to Espadrille.
All payments should be made in Pounds Sterling.
Credit card information for the purpose of making a payment can be given to Espadrille via phone or through Espadrilles secure website which encrypts the information given.
DELIVERY
Items which can be supplied from stock will normally be dispatched within 3 working days of acceptance of order.
Any item which requires subsequent ordering will normally be delivered within 30 working days of acceptance of order. Should expected delivery exceed 30 working days we will inform you as soon as possible.
Espadrille will use reasonable endeavours to meet any date agreed for delivery, however in exceptional circumstances additional delivery charges may be applicable. Espadrille will not be liable for any losses, costs, damages or expenses incurred directly or indirectly out of any failure to meet any estimated delivery time.
Delivery will be made to the address specified in the order and you should make all arrangements necessary to take delivery of the items.
In the event of any item being returned to Espadrille due to non-delivery, you will be advised. Redelivery costs cannot be our responsibility.
If you are ordering from outside the EU, any customs or import duties levied once the package reaches your destination country are your responsibility.
CANCELLATION AND RETURN POLICY
You must inform Espadrille by phone or email within 24hrs if you wish to cancel your order. Espadrille reserves the right to charge a 20% restocking fee if their order is cancelled after that time limit. Please Note: Orders cannot be cancelled once they have been despatched.
You must inspect your items immediately upon receipt and notify Espadrille by phone or email within 24 hours of delivery if they are defective or damaged, or of an incorrect quantity.
If you receive a defective or damaged item from us you must promptly return it to us along with the original packaging for replacement. Should this happen we will refund you any postage charges you have incurred
We will exchange items provided they are returned to us promptly in an ‘as new’ condition, along with the original packaging. Unfortunately, we cannot refund the postage cost for exchanges and certain items may also incur additional re-shipping charges
Espadrille cannot accept responsibility for any items that have been damaged due to misuse, through not following the care instruction where applicable, or are returned without their original packing.
Espadrille is not liable for incorrect lengths of fabric ordered and is under no obligation the offer refunds in such instances. You should also be aware of the Care Instructions listed on our website and take these into account prior to placing your order.
PRIVACY
Any and all information you submit to Espadrille, via its Website, email, phone or by hard copy will be treated in the strictest confidence. We will hold any personal information which you provide to us in compliance with the principles of the Data Protection Act and it will be used solely for processing your orders and for accounting purposes. We would like to retain your email address in order to inform you of future promotions, however, should you not wish to receive these please let us know by email. Under no circumstances will we ever pass your information on to others parties.
GOVERNING LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the Law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
